Welcome to JournAI. By using this app, you agree to these Terms of Service and all related policies.
1. Acceptance of Terms
By accessing or using the app, you agree to be bound by these Terms.
2. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. JOURNAI DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
3. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOURNAI’S TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE GREATER OF (A) FEES PAID BY YOU TO JOURNAI IN THE PRIOR TWELVE (12) MONTHS, OR (B) €100. IN NO EVENT SHALL JOURNAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
4. Indemnification
You agree to indemnify, defend, and hold harmless JournAI and its affiliates, officers, and employees from and against any claims arising out of your use of the app or violation of these Terms.
5. Governing Law & Forum
These Terms are governed by the laws of Malta. Any dispute shall be resolved through individual, binding arbitration in Valletta under ICC rules, in English. You waive any right to jury trial or class/collective actions.
6. Class Action Waiver
You agree that any dispute will be brought in your individual capacity only and not as a class or representative action.
7. Severability & Survival
If any provision is held invalid, the remainder remain in effect. Sections 2–7 survive termination of your use of the app.
8. Termination & Suspension
JournAI may suspend or terminate your access at any time for any reason, without liability.
9. Entire Agreement
These Terms, together with the Privacy Policy and Legal Notices, constitute the entire agreement and supersede prior agreements.
